One of the things we must never forget in our society is that we all have rights — basic, simple, civil rights that are granted to every man, woman and child. We have these rights because without them, the concept of liberty would be dead. These inalienable rights are part of the criminal justice system itself, as people who are accused of a crime must be done so in accordance with the law and the police officers and prosecutors involved must follow strict protocols. Any deviations from these norms and that case against the accused person could collapse.
Violations of civil rights and false arrest allegations are serious ones. When an accused individual is incorrectly or improperly arrested by the police, then that lack of probable cause or that lack of adherence to proper protocol should not be swept under the rug.
The accused individual must stand up for himself or herself. False arrests can lead to civil litigation in which the individual who was falsely arrested can seek compensatory damages against the police for their actions. False arrest isn’t the only violation that police officers can commit, though. Excessive force, police brutality, malicious prosecution and illegal search and seizure are a few other examples of shoddy, illegal police work.
The system may be against you, but it isn’t always right — and it also doesn’t always come out on top. Hold the system responsible and discuss your case with an attorney as soon as possible. We at The Law Offices of Michael V. Cibella would be happy to answer your questions and review your case.
